In addition to the warning letters, in February of 2009, the FDA and the attorneys general of 27 states went even further and took the unusual step of requiring Bayer to spend more than $20 million on corrective advertising in an attempt to remedy its misleading marketing and that the company get pre-approval from the agency for all of its advertising for the birth control pills for the next six years.
At the same time that the FDA and some states' attorney general have been expressing concern about the marketing practices for Yaz and Yasmin, women around the country have been bringing lawsuits alleging health problems associated with the pills - including blood clots, damage to the bladder and kidneys, stroke, and heart attacks. The primary concern centers on drsp and its link to increased potassium in the body. Two studies published in August 2009 in The British Medical Journal found a higher risk of blood clots with the use of newer progestins, including drsp. Bayer has produced its own study stating that there is no higher risk associated with the pills.
